Epic item tade in: would a figurine be game breaking?

Some of the epic level figurines look pretty powerful and I was wondering if they would break encounters at the PC current level.

Example:
Guenhwyvar AC35 +26 to hit AC 2d8+9 damage

It looks like it's a daily item, so only one use per day, but if multiple players had one...
Guenhwyvar - Level 21 figurine:

Guenhwyvar
Medium natural animate
Initiative as conjurer        Senses Perception +20; Darkvision, low-light vision
HP 50; Bloodied 25
AC 35; Fortitude 33, Reflex 35, Will 33
Speed 8, climb 6

Claw (standard, at-will)

+26 vs AC; 2d8+9 damage, and Guenhwyvar shifts 1 square.

Bite (standard, at-will)

Targets a prone creature; +26 vs AC; 2d10+10 damage, and the target is grabbed (until escape).

Charging Pounce (standard, at-will)

When Guenhwyvar charges and hits with her claw, she deals 2d8 extra damage and the target falls prone

Combat Advantage

When Guenhwyvar hits a creature with her claw attack and the creature is granting combat advantage to her, the target falls prone.

Alignment Unaligned        Languages Common, Elven, (cannot speak)
Skills Acrobatics +22, Athletics +20, Stealth +22
Str 20 (+15)      Dex 24 (+17)      Wis 20 (+15)
Con 17 (+13)      Int 6 (+Cool      Cha 10 (+10)

Yeah, but that was in epic PC battles. In heroic/paragon, the figurine would be tough.

So, most of us have Level 27 plus items, e.g. +6 weapons and or +6 armor, is the level 21 figurine more powerful overall than those higher level items? I guess what I'm thinking you're asking is: since the stats of the figurine seem to be significantly higher in terms of AC and plus to hit versus what the PCs are, should it be allowed in the game?

.i.e. Josie's AC is 30 under most circumstances and the figurine is AC 35. With her +6 weapon, Josie is +16 to hit versus the figurine which is +26 to hit. With Josie's AC and plus to hit not being too far off those of the other PC's would having a figurine with much higher AC and much higher plus to his be more off balancing than 7th Level PC's having other items of Level 27+.

Pretty much...

It seems that having one or more figurines could unbalance encounters. They are tougher than most PC in AC and toHit, but don't do as much damage as the strikers in the party, probably on par with defender types.

The turtle, serpent, and dragon figurines are pretty tough as well...

And you only have to use a Minor Acrion to control it.
